The dispute stems from a November 2020 vote, when the Council of the EU adopted a resolution supporting changes to the UN’s classification of drugs and psychotropic substances.

Hungary opposed the resolution and issued a separate declaration, prompting the European Commission to sue for breaching the EU’s exclusive rights and undermining the council’s resolution.

In its ruling, the court sided with the EC, stating that Hungary had failed to uphold its obligations under EU law.

It affirmed the EU’s exclusive right to adopt a unified position on such matters and said the principle of loyal cooperation requires member states to support the union’s objectives and refrain from actions that could jeopardize them.
