According to the verdict, it was not lawful when last year the European Commission (EC) tightened the quality requirements for intervention maize. The decree was made on October 18, 2006 and applied for the maize sown in spring 2006 as well. The court accepted the Hungarian government’s argument saying that EC had made the decision too late and violated maize farmers’ reasonable trust. Earlier the government said the new requirements were discriminatory as Hungarian farmers were not given time to prepare for them. Also, according to the court, EC could not prove that specific weight affects the quality of maize and the regulation was made without due consideration.
