Hungarian drugmaker Richter Gedeon Rt must withdraw a product for the treatment of osteoporosis from the Hungarian market, according to a non-binding Budapest City Court verdict, the company announced. The lawsuit was initiated by US drug giant Merck and Co Inc., which produces a medication with the same active ingredient and claims that Richter?s product infringed its patent rights. Richter will appeal the verdict. The company started to market its product in April 2005 after a successful appeal to the Hungarian Patent Office to cancel Merck?s patent on the active ingredient.
