Court rules radio frequency decision partially invalid, but tender still stands
The Budapest Municipal Court of Appeals on Wednesday ruled partially invalid because of formal shortfalls a decision by the National Media and Infocommunications Authority's Media Council awarding a frequency to Autórádió Műsorszolgáltató.
The court ruled that Autórádió's application for the frequency was not signed as formal conditions in the tender indicated.
The tender does not have to be repeated because of the ruling, but the council must review the invalidity in the course of making a new resolution, and it must take a new decision on a winner in the tender.
The court case was brought by Klubrádió, which was runner-up in the tender for the frequency, being awarded 65 of a total possible 71 points in the evaluation. The winner was awarded 66 points.
